# Toshokann licensing paths

Toshokann is available through an open-source path, a commercial path, and a community-access path. This page explains the intended choices; the controlling terms are the license file or separate written agreement that applies to a particular recipient.

The repository's [`COMMERCIAL-LICENSE.md`](../COMMERCIAL-LICENSE.md) is an informational availability notice. It is not itself an alternative license grant.

## Open-source use: AGPL-3.0-only

The repository is licensed under the GNU Affero General Public License version 3.0 only. The AGPL path is available without a fee to individuals, nonprofits, educational institutions, community organizations, governments, and businesses.

The AGPL does not prohibit commercial use. A commercial user may run, modify, distribute, and charge for AGPL-covered software while complying with the license. The [GNU license FAQ](https://www.gnu.org/licenses/gpl-faq.html) explains commercial use and distribution under the GNU licenses. Among other obligations, a modified version operated for users over a network must offer those users the corresponding source in the manner required by the AGPL.

## Commercial license

For Toshokann material it owns or otherwise is authorized to license, The Wizard Nexus LLC can offer a separate written commercial license for organizations that need terms different from the AGPL, including proprietary or closed-source products, private white-label deployments, or commercial derivatives that cannot meet AGPL obligations.

Commercial terms, scope, support, updates, branding, and fees are determined in the written agreement. A request or conversation is not itself a license grant.

## No-cost community license or derivative

Qualifying nonprofits, educational programs, community and public-interest organizations, open-knowledge projects, and other public-benefit users may request:

- a no-cost alternative written license;
- a no-cost configured Toshokann derivative;
- or both.

Eligibility and scope are considered case by case. The written grant identifies the covered repository version, organization, permitted use, derivative, redistribution terms, duration if any, and any support boundary. Until that grant is issued, the AGPL remains the available license.

A no-cost derivative may configure identity, appearance, taxonomy, catalog structure, and supported workflows. It does not imply free hosting, content preparation, preservation services, ongoing support, third-party services, or provider usage unless those items are explicitly included.

## Request a license or derivative

Use [The Wizard Nexus contact page](https://thewizardnexus.github.io/TheWizardNexus.com/contact.html) and choose how to email us. Mention Toshokann and include the inquiry details below. Do not submit credentials, private records, or other secrets through a general inquiry.

Include:

1. the requesting person and organization;
2. whether the organization is commercial, nonprofit, educational, governmental, community, or another public-benefit type;
3. the intended Library or Archive derivative and who it serves;
4. whether the deployment or derivative will remain open source;
5. expected distribution, hosting, white-label, and support needs;
6. the requested commercial or no-cost licensing path.

## Third-party rights

A separate license can cover only rights that the licensor has authority to grant. Third-party components, trademarks, content, models, services, and contributed code may carry their own terms. A written alternative license will identify any exclusions or continuing notices.
